Welcome to Topescape, a website owned and operated by Rubisco DOO. These Terms of Service ("Terms") govern your access to and use of our website (the "Site") and services (the "Services"). By accessing or using Topescape, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the Site or Services.

By accessing or using the Site, you confirm that you accept these Terms and agree to comply with them. These Terms apply to all visitors, users, and others who access or use the Site.

When using Topescape, you agree not to:

• Submit false or misleading information, including creating fake reviews for escape rooms.
• Attempt to interfere with the proper functioning of the Site or Services.

Escape room owners are strictly prohibited from leaving reviews for their own rooms or soliciting others to do so.

5. Account Registration

To access certain features of the Site, you must create an account. During registration, you will be required to provide an email address and select a username. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.

6. Content Ownership

User-Generated Content: Users own the reviews they post on Topescape. By submitting a review, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the Site.

Escape Room Content: Escape room owners own the images, descriptions, and other content related to their rooms. However, Topescape may, from time to time, upload content about escape rooms based on publicly available information from the owner's website or other sources. By providing content to Topescape or by allowing us to use publicly available content, you grant us the right to use, display, and modify this content on the Site. If you are an escape room owner and wish to claim ownership of or request changes to content associated with your room, please contact us at info@topescape.rs.

7. User-Generated Content Guidelines

You are solely responsible for the content you submit to Topescape. We reserve the right to remove any content that violates these Terms or is otherwise inappropriate.

8. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our privacy-policy to understand our practices.

9. Termination

We reserve the right to suspend or terminate your account at any time, without prior notice, if you violate these Terms or if we determine that your actions may harm the Site, Services, or other users.

10. Disclaimers and Limitations of Liability

No Warranty: The Site and Services are provided "as is" and "as available," without any warranties of any kind, either express or implied.

Limitation of Liability: To the fullest extent permitted by law, Topescape shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your use or inability to use the Site; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

11. Featured Placement for Escape Room Owners

11.1 Overview

Escape room owners on Topescape have the option to feature their rooms in a dedicated section of the website for increased visibility. By opting into this service, owners agree to the terms outlined in this section.

11.2 Pricing and Duration

• The cost for featuring an escape room is 5,000 RSD per week.
• Owners can select the specific week(s) they wish to be featured by booking in advance through the platform.
• The minimum booking duration is one week.

11.3 Booking and Scheduling

• Featured placement spots are available on a first-come, first-served basis.
• Owners must schedule their featured weeks in advance. The platform will provide available slots and confirm the booking once selected.
• Once a booking is confirmed, it is considered final and cannot be canceled or modified without prior approval from Topescape.

11.4 Invoicing and Payment

• Invoices for featured placements will be generated at the end of each month based on the number of weeks the escape room was featured during that month.
• Payment is due within 10 days from the date the invoice is issued.
• Payments can be made via bank transfer.

11.5 Late Payment and Penalties

• If payment is not received within the specified payment period, a late fee will be applied according to the applicable laws and regulations.
• Continued non-payment may result in the suspension or termination of the escape room's profile on Topescape.

11.6 No Guarantee of Results

While featured placements are designed to increase visibility, Topescape does not guarantee any specific results, such as increased bookings or reviews, from being featured.

Owners agree that they are purchasing the visibility service as-is, without any promises or warranties regarding performance.

11.7 Changes to Featured Placement Terms

Topescape reserves the right to modify the terms, pricing, or availability of the featured placement service. Any changes will be communicated to owners in advance and will not affect bookings that have already been confirmed.

12. General Provisions

• All other terms and conditions, including those related to content posting, account management, and data privacy, apply to escape room owners as they do to standard users.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Serbia. You agree that any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Belgrade, Serbia. However, if you are a consumer based outside of Serbia, you may also have rights under the mandatory consumer protection laws of your country of residence.
